August 15, 2009, Seoul—The Dong Bang Shin Ki incident, which erupted due to SM Entertainment and their unfair contracts, is struggling to find a resolution. In the midst of this, in order to prevent a second DBSK situation, the emerging consensus is that large-scale entertainment producers with capital must find a way to transcend the hard training model and utilise the media to come up with a better star management system.

On the 14th [August] at the joint cultural conference hosted by the Munhwayeondae held at the Francesco Conference Room on the ‘Exposing the problems of the entertainment management system and finding an alternative through the Dong Bang Shin Ki incident’, Hanyang University professor Tak Hyun Min, a panellist in the panel discussion section, said, “Even if SM comes out waving the white flag this problem won’t end,” and in order to solve the fundamental problems, “we have to make it possible for stars to make without having to depend on giant management companies.”


The logic of SM ‘If you leave us you can’t be as famous as you are now’ must be broken

According to Professor Tak, “Even up to the early 1990s there was no such thing as the giant entertainment company, and artists signed with record labels where, granted, the record label had the superior position relative to the rights of the singer”; also, “the one who broke this unequal relationship was Seo Taiji,” he emphasised. Although right now the  one-person-led entertainment company is the norm, even up to the early 1990s it was a difficult sight to see. He said, “Seo Taiji set up his own agency so that he wouldn’t become hostage to a record label or the press and his band would be able to produced the music that reflected their own style,” also adding that, “while Dong Bang Shin Ki’s personal interests in this are important, in order for Korean popular music, which has at its centre similar idol stars and groups, I would like to request [Dong Bang Shin Ki] to lead the way in finding a new and improved road for the pop culture business system,” revealing his position on the subject.

When one Dong Bang Shin Ki fan expressed, “It’s not going to be all that easy for Dong Bang Shin Ki to change the system like that as you say,” he replied, “If Dong Bang Shin Ki really has 800,000 fans and if those fans stand by the three members(Youngwoong Jaejoong, Micky Yoochun, Xiah Junsu) who deposited the injunction request for invalidation of their exclusive contracts in full support then it’s more than possible.” The reason why SM was able to throw away H.O.T saying, “if you leave us you can’t achieve the same level of success/fame” is because they  (SM) were confident of this idea, Professor Tak explained. This means that if Dong Bang Shin Ki becomes more successful even after leaving [SM], the issue changes entirely.

Professor Tak continued, “Those who will make it possible for these men to fill this role [of pioneers in the Kpop industry] are the consumers and Dong Bang Shin Ki fans who give them full support in the market,” and “if the 800,000-strong Cassiopeia and Dong Bang Shin Ki together make this a reality, it will represent an instance where our music industry and system turns inside-out [via fan-power].” Professor Tak added that what ‘Cassiopeia’ needs to communicate is “not a boycott against SM but that the other two should come out, that it’s okay to come out because you don’t need a giant management company to survive in the market and because we’ll help you.”

Dong Bang Shin Ki’s penalty for breach of contract currently 400 million USD

The panel’s follow-up speaker, Lee Dong Yeon, Professor at the Korea Combined Arts School pointed out, “The conditions of the contract between Dong Bang Shin Ki and SM clearly state that in the case where Dong Bang Shin Ki breaches the contract they would have to pay the management company the equivalent of 400-480 million USD,” adding, “for a contract arranged between Asia’s top-quality idol group Dong Bang Shin Ki and a top entertainment management company it is extremely unequal.” He later commented, “If it doesn’t want the breakup of an idol group at the peak of their fame, SM will also have to accept a more progressive and far-sighted position” in a way that incorporates transparent income reporting as well as a stable ‘income distribution + incentive’ model in its solution.

Professor Lee Dong Yeon urged aggressive/enthusiastic actions from ‘Cassiopeia’. He stated, “First, you will have to communicate to SM that you find the position of the three members just and righteous, that now that the three members have taken the direction of stepping out of SM through a legal channel the fans are behind them and will no longer tolerate the five of them being abused by their management company or their managers; this is the kind of direct and aggressive stance that needs to be shown by the fans.” He also added, “I think that Dong Bang Shin Ki’s vocal skills and dance skills are currently the best in Asia and the idol market,” so, “if all of you (Cassiopeia) stand by them they should have no problem succeeding on their own.”

The Dong Bang Shin Ki incident must not be seen as a problem of finances but as a problem of ‘the right to health’ and ‘human rights’

During today’s panel discussion, a fan of Dong Bang Shin Ki, Ms. Kim Eun A, came forward to reveal the position of the fans. She said, “In the 68 months since Dong Bang Shin Ki’s debut they have been flown around the world six times” and that their year-long schedules didn’t even include a rest period longer than 2 weeks. “One time, upon completing their Japan tour, the same week they were flown to Taiwan where they had to use a different language and sing and dance to an entirely different repertoire. Such an inconceivable schedule has led fans to say, this must be why their name includes ‘gods/god-like strength’. She continued, “Because it took the courage of the three members to engage in a lawsuit like this, we ask that you don’t simply view Dong Bang Shin Ki’s problem as that of finances or money but as a problem of the right to health and human rights.” She said of SM, “if you (SM) are not willing to improve yourself in this area of unfair slave contracts, then at least have the decency to let the five members go and not interfere in their activities afterwards.” Then she concluded, “if [SM] adds new members under the name Dong Bang Shin Ki that new group will be regarded as nothing but a ‘counterfeit’ Dong Bang Shin Ki by fans.

Even if it was delegated comprehensive authority the management company’s authority is limited

Lawyer Park Ju Min (law firm Hangyeol) elaborated on the legal aspects of this incident: “Even if a management company claims that it rightfully received the right to exercise comprehensive authority over the celebrity through delegation [translator’s note: he’s talking about the concept that in signing the contract DBSK members voluntarily gave up their rights to…well…everything] it is still obligated to ask for the permission of [the celebrity] when it comes to [the celebrity’s] individual projects.” Lawyer Park then added, “it is still possible for a management company to fulfil its role toward its signed entertainers whilst maintaining its authority,” and “the trend revealed by this incident is that in the contractual relationship between the management and their signed entertainers, the weaker side is the entertainer; but, accepting this, it is possible to channel this authority into protecting the entertainers.”

In addition, “the penalty that Dong Bang Shin Ki would have to pay for breach of contract, at 400 million USD, is too high,” and “as severe as the unfairness of the contract is, the imputation of blame/responsibility [to SM] is too small and progressively reduced.”

Also of note, SM’s representatives were invited several times to the panel discussion but in the end did not show up.

    • Yeap, SM never answers to the actual questions put forward to them by experts and members, but only play with media to make JYJ is betrayer of family and loyalty. They never confront the fans’ demand but oppress JYJ’s tv appearance, while promoting 2vxq to unprecedented level with 70,000 ads. If SM, you are confident, talk to us about the very questions of justice. And their failing do so makes us fans more angry and get united to defend our boys. If foreign fans feel Kcassis are divisive in defening JYJ, please see what SM is doing… you will understand our activity is not to simply harm SM but to bring justice to SM and our own country.

  3. I wonder why these kind of articles were not circulated before? It could have prevented a lot of fans from hating/blaming JYJ. 😦

      • Alas, we Kcassies have been abstained from attacking back to Homin fans’ attack, because we had hopes for 5 member reunion, at least until KYHU lyrics and all HM intv opened “hell-gate” as Kfans call it, revealing HM take the same position with SM. We have been their fans for 7 years anyway, and still can’t believe what HM is doing. That’s why recently many Kfans start to be active on twitter and blog.

      • Part of it is timing, too. I remember reading a translated summary of this panel discussion at the time, because I remember what the professor was saying. But in mid-August 2009, things looked a little different than now. 5-man Tohoshinki was performing in Japan for a-nation and had more Japanese activities scheduled for the rest of the year. And during a-nation, they were on stage as the 5 smiling, hard-working boys we love — no signs that they couldn’t get along with each other or anything. SM Town was scheduled with 5-man TVXQ supposed to appear; I don’t think it had been canceled yet. Hopes for the 5 continuing to work as 5 (at least in Japan) were high back then. I think the fans thought/hoped that the lawsuit would not rip the boys apart the way it did.

        It is really great that JYJ Files is sharing these reports and translations now, because what the panelists said in 2009 is still true today.

    • I’m too hoping international media can pick this up. International fans are really veiled by what’s really happening in Korea, and having interviews and articles translated differently, can’t thank Jimmie enough for getting the translation done.

      Can we get these articles to the MTVs of every country, that should be a good start as they are music people. International fans, I think, are buying into the idea that 2TVXQ is keeping the legend alive.

      A lot of international fans are actually shocked by what has transpired in Korea and HM’s responses in interviews came as quite a shock to them. It’s not about taking sides, but the music / entertainment industry in Korea and it’s impact on their artistes.

  6. What i wonder about…why i-fansites do not want to take side and do not want to involve in this fight??? It is for justice, and JYJ never said otherwise…so frustrating and sometimes felt like what kind of pathetic to juggling both parties…huhhh..

    • That is exactly what I always have in my mind.
      I was always wondering about the serious lack of this kind of information in the JYJ case – SM is a leading entertainment company and DBKS is a cultural icon.
      It’s a bit sad to know that actually academic authorities/professionals/experts alike have talked about the issue long time ago and it’s just now that we know about it. But it’s a step forward indeed. Thank Jimmie for the translation!

    I was really sad seeing how some people react to this matter
    Why people do not realize about these things? Why I feel that is like JYJ and their fans against the rest of the world? Why I feel that nobody cares about this? Why so many people try to justify SM actions? Why ?!

    Seeing JYJ´s case, as a fan and as a human being makes me feel sad, mad and worried…

    Don´t what to do anymore, I´d really like to support them more in this situaton but everything seems so difficult!

    Actually, all my hopes are on the new album and on the results of the lawsuit.
    Because if JYJ win, the broadcasting stations wont have any excuse to avoid JYJ ´s appearence on TV, radio,etc.
    And, if the new album breaks the sales records and sells well (a bit more than well)
    JYJ and their fans will show SM and the rest(haters) that they not need them to be successful, they will show them that they can be successful with their own music and style and they will show them too that JYJ is not just mere pre-fabricated idolos by an entertainment company …
    I already know this (The new songs of Music Essay are ,seriously and without being biased, amazing). I love ALL the songs of the album … all of them! I´m so proud 🙂

    It seems we finally have word from the company that seems to be tangled in this mess.

    When the TVXQ / DBSK / Tohoshinki controversy first began, the three members and their lawyers clearly stated that the three members’ investments in the CreBeau cosmetics line did not have any relevance to the court case. The core of the controversy was the legal issues of the slave contract. In SM Entertainment’s opening statement, they stated that the lawsuit was because of the cosmetics issue.

    To clear up the confusion, Kang Suk Won, the President of the Korean branch of CreBeau (Wishop Plus) was interviewed. Kang has already sued SME’s CEO Kim Young Min for slander to the Seoul Central Court on October 4th, 2009.

    Kang said, “Although this case is obviously to fight the unfair profit splits and the conflict between the members and SME, SME is trying to push the blame onto CreBeau.”

    Kang went on to reveal that the three members have only invested approximately 70,000 dollars, 60,000 dollars, and 40,000 dollars respectively. This amount, he said, was not enough to earn the three members rights to ownership of the business, let alone a big part of the profit.

    Kang said, “In May 2009, some SME representatives visited the original branch of CreBeau Cosmetics in China twice. They determined that the members were not going against contract terms in any way, and now SME is distorting the true reason behind the case and putting out ridiculous claims… SME said that the whole lawsuit was due to the members’ wanting to continue a business that went against contract terms. This has no credibility in that SME has already approved of the investments previously. The members wouldn’t risk all the things that they gained as TVXQ by creating a conflict with their company over insignificant investments. It was a private investment, and the three have no ownership over the business in any way. They’re merely investors, nothing less, nothing more. What does this have to do with the lawsuit, and why is SME attempting to connect the two together?”

    Kang went on to say that SME’s actions have brought about significant harm to the business not only in Korea, but all over Asia, including China, Japan, Hong Kong, Taiwan, Vietnam, and even the United States. For the employees and CEOs all over the world, CreBeau is their sole income. SME should have considered the impact its blames would bring to the business and the people involved in it.

    “If SME’s company and its profits are so important that they are willing to harm others for it, then SME should recognize that it is the same for others.” Kang went on to say that “If SME does not stop distorting the truth and doesn’t apologize for the harms it brought upon CreBeau, I will not hesitate to reveal the details of SME’s absurd act to the public and to the court.”

    That statement made made my eyes water. Because notice how WELL JYJ is doing outside of SM. That statement is true that’s why I cringed when HoMin decided to make a statement that fed the ‘family abondon/betrayal’ thing. They’re making it something it’s NOT. BUSINESS is not family. SM uses that to lure you in. I hope HoMin and their fans come to their senses.

    Like honestly SM can do a better job than what they’re doing now.
    Stop assuming the type of business SM is running is the ONLY way business can be ran (to HoMin and Homin’s fans). Stop assuming that this ‘big family’ thing SM is running is all perfect and innocent. Like I keep saying, no business is perfect. Every business has it’s corruptness but it’s on a spectrum. When a business gets too red, it’s time to either, change, mutate or die. All the bands before TVXQ and their problems with SM, the guy from Super Junior, and now the three from TVXQ is accumulating proof that SM needs to try to embrace better business practices.

    Who will say he choose a little cosmetic shop more than a group again?

        Please explain why on earth they cannot just supeona the witness to appear. Am confused. Did they delay the hearing due to lack of compromise or because the witness failed to appear.

        Am loosing faith in the korean justice system if they can let something like a witness failure to appear in court be brushed off as nothing huge.

      • I feel like they do it on purpose to use the benefit of the lawsuit.
        If the news about the lawsuit is still in everywhere so I think SM is happy enough to prolong it. This will benefit TVXQ Duo but not for JYJ for sure.
        I hope the lawsuit in March won’t be postpone again.

        Can jyj’s side not ask for time contraints on the lawsuit or does the korean justice system not have that. Am so confused because i do not see the reason presented for the delay as valid and it makes the whole justice system seem like huge joke.

      • I am also wondering why the judge didn’t subpoena the witness. I wasn’t able today, but tomorrow or in the next few days I plan to ask a prosecutor friend of mine. But yeah…the court’s actions today looked unprofessional, to put it mildly =_=;;

    • So I just got off the phone with my Korean prosecutor friend. According to him, in the Korean court system, the authority of the judge to subpoena a witness only lies with judges of the CRIMINAL courts and higher. The JYJ v. SM case is taking place in a CIVIL court, and one at the lowest level too (district level). The judge isn’t as free to issue subpoenas when a witness doesn’t show up. With that said, there IS a limit to the witness’ ability to be absent….at some point the judge CAN force the person to show up, just not as easily as a criminal court judge can. He also said JYJ could’ve gone to the criminal court and it might have been better for them…because with the way things are right now on the level of the civil court, the burden of proof lies with JYJ (to prove the contract is so horrible and FRAUDULENT that it’s invalid). He says anticipate a hard fight, but stay optimistic ^^.

      It still sucks how things went down yesterday, but I hope you all understand a bit better now.

        Its very frustrating even for the judge I’ld assume if they can’t do much about it. It seems it will be a very hard for them as SM will be using all the loop holes in the judicial system to their advantage.
        Hopefully, at the end things turn out well for them. Could JYJ’s lawyer take the lawsuit to a criminal court mid-lawsuit and doesn’t that not have the probability of turning nasty as some can of worms might be opened because their lawyer would have to use everything to prove their point including past abuses that might have occurred.

        Also, I’ve read about Kara’s filing contract termination. How are things in Korea with respect to that and the general public reaction.

        The Kara situation is interesting…I dunno about others in Korea yet but I personally am kinda shocked, not that an incident like DBSK has happened (I’ve been warning for a long time now that unless Korea gets serious about K-ent industry reforms DBSK-like situations will only become more frequent) but that it came out of DSP of all places o_O…but I suppose after the departure of SS501, the company put more pressure on Kara to bring in the $$ that SS501 would have brought in.

      • Jimmie, I have a question about what your prosecutor friend said. Why do you think that JYJ and their lawyers decided to take civil action against SME if the burden of proof is on them rather than take criminal action first (which could have been better for them)? What reason might that be? I realize that only JYJ and their lawyers know the real reason(s), but from a legal perspective, I am curious why they went civil over criminal action. Also, how long can this drag on? I know that is such a difficult to answer but is there a timeline when it comes to civil cases? I appreciate all your work and replies on this Jimmie–you are fabulous!

      • Don’t quote anything I say because I don’t work in Korean law but the impression I got from my prosecutor friend is that there wasn’t enough proof of criminal activity by SM to warrant going to criminal court. The State prosecutor has gone through SM’s records before and even raided the building I think on one occasion on suspicion of white-collar crimes but found nothing. It’s only now with SM’s financial records being impounded by the court, SM dragging its feet on handing in those documents and the failure of the financial manager to show up that possible criminal activity is coming to the surface in an undoubtful manner (before, it was all rumours…SM cheating on their accounting, being involved with Mafia loan sharks, etc.)…so my friend says that even now it’s not too late to bring in Korean criminal law into play, even if the case is a civil case in a district court. But it’s up to JYJ’s lawyer whether or not he’ll take this strategy.

        Okay, no wonder…>< Although you said that Judge of the civil court isn't as free to subpoena a witness, and the witness could be no show. In this case, could we accuse the witness of contempt of court? (as there's no way to "force" the witness to come) Is it possible for the court to abandon the witness? And 1 thing, SM kept delaying their submission of documents that the court orders, wasn't there any deadline given? This's so "….." to me.

God I love this statement where Professor Tak added that what ‘Cassiopeia’ needs to communicate is “not a boycott against SM but that the other two should come out, that it’s okay to come out because you don’t need a giant management company to survive in the market and because we’ll help you.”

      First of all, I have to say thank you Jimmie for translating this article to us. Why the hell I never ever saw this article translated before? Such a useful information to us fans and to those who wanna take this case as their study.
      I’m so happy that there are so many people in Korea support JYJ and on top of that these people are well educated. SME’s action on the request for attending this discussion was like —–NONE, NOTHING. Shame on you SME. If you really sincere and confident enough in your management system, just come out and have discussion with them.
